If you are a user of Instagram or Facebook, be aware that Meta is utilizing your data to train its AI models. The company uses user posts as training material for its generative AI systems. In compliance with privacy legislation in the UK and European Union, Meta is obligated to provide an opt-out option. However, the way in which Meta is offering this opt-out can be viewed as questionable. Meta utilizing user data to train AI models Had it not been for privacy legislation in Europe, we may have been unaware that Meta is utilizing our data to train its AI models. This legislation mandates companies to disclose their data acquisition, processing, and retention methods, as well as provide options for opting out. In order to adhere to these regulations, Meta is currently sending emails to Instagram and Facebook users. Subject: We're updating our Privacy Policy as we expand AI at Meta Hello, [Name], As we prepare to expand our AI at Meta experiences into your region, we are updating our Privacy Policy. AI at Meta encompasses various generative AI features and experiences, including Meta AI and AI creative tools, as well as the underlying models. Here's what this means for you: To bring these experiences to you, we will now rely on the legal basis known as legitimate interests to use your information for the development and improvement of AI at Meta. It is important to note that you have the right to object if you disagree with how your information is being used for these purposes. If your objection is accepted, it will be respected from that point forward. We have included updates in our Privacy Policy to reflect these changes, which will take effect on June 26, 2024. Thank you, The Meta Privacy team Additionally, a similar notification is being displayed through Facebook notifications. It is worth noting that users outside of Europe do not appear to be receiving these notifications. Opting out for European users The General Data Protection Regulation (GDPR) in Europe is globally recognized as the most robust privacy legislation.

It offers four main protections against the misuse of personal data: 1. Data processing must have a specific, lawful basis. 2. Personal data must be encrypted. 3. Individuals have the right to obtain a copy of their data. 4. Individuals can request the deletion of their data. Companies are permitted to hold your data for six acceptable reasons, one of which is Legitimate Interest. However, the definition of Legitimate Interest is somewhat vague and includes "commercial interests. " Meta is relying on this clause. Nevertheless, even if a company claims Legitimate Interest, you still have the right to object and request the deletion of your data. Concerns regarding Meta's wording Meta's email suggests that it will only remove your data from its AI training "if your objection is honored, " implying that this process is not automatic. When clicking on the objection link, you are asked to state your reason for objection. Both of these practices raise legal concerns as they create the impression that you need to provide a justification for your request. In reality, when a company uses your data solely for its own commercial interests, it must comply with opt-out demands without requiring additional justification. Fortunately, Meta seems to be automatically processing opt-out requests. After opting out, I promptly received an email confirming the approval and honoring of my request.
