OpenAI also mentioned the need for more resources to develop AGI and stated that Musk and the company agreed in 2017 that a for-profit entity would be necessary to obtain those resources. Legal experts have suggested that Musk may face challenges in court. Attorney Seth Kugler, who specializes in AI and corporate governance, stated that it would be difficult for Musk to prove that OpenAI abandoned its original mission by licensing GPT-4 and keeping certain elements proprietary. Kugler explained that in order to demonstrate a breach, Musk would need to establish that GPT-4 is an example of artificial general intelligence, which refers to an AI capable of performing any task as well as or better than a human. This includes the ability to learn new tasks beyond its initial training, essentially serving as a high-level substitute for human intelligence.
