State Legislators Lead AI Regulation Amidst Federal Inaction

Colorado's law, for instance, targets high-risk AI systems in areas like hiring, banking, and housing, mandating developers to avoid bias and disclose algorithmic discrimination. State legislation covers various aspects of AI, such as collaboration, data privacy, transparency, discrimination prevention, AI use in elections and schools, and the criminalization of explicit AI-generated images. Additionally, legislators highlight the importance of keeping up with AI advancements while considering the potential for job creation.

State legislators are taking matters into their own hands as Congress has failed to pass any new federal laws on artificial intelligence (AI). Colorado recently enacted a comprehensive regulatory law aimed at mitigating consumer harm and discrimination caused by AI systems. Other states, such as New Mexico and Iowa, have focused on regulating computer-generated images in media and criminalizing sexually explicit computer-generated images. Many lawmakers believe that waiting for federal action is not an option, as constituents demand protections.

Currently, 28 states have enacted AI legislation, and over 300 AI-related bills have been introduced in 2024. The legislation covers various aspects such as interdisciplinary collaboration, data privacy, transparency, protection from discrimination, elections, schools, and computer-generated sexual images. While there are concerns about stifling innovation, some believe that state actions may create pressure for federal regulations due to the competitive nature of the AI industry. Despite the challenges of legislating rapidly evolving technology, lawmakers are excited about AI's potential and the prospects of job creation.
